Terms and Conditions

MM Web Design (Pty) Ltd

Please read these Terms and Conditions carefully before using our website design, hosting, email, domain registration, or related services. By purchasing or using any service from MM Web Design (Pty) Ltd (“we”, “us”, “our”), you (“the client”, “you”) agree to be bound by these Terms and Conditions.

1. SERVICES OFFERED

MM Web Design (Pty) Ltd provides website design, website hosting, domain registration, email hosting, and related digital services based on selected packages.  Website design and hosting packages start from R49 per month, subject to the chosen plan and scope

2. DOMAIN REGISTRATION

  • Domain names are registered through third-party registrars.

  • Once a domain name is registered, it is non-refundable.

  • MM Web Design is the registered owner of the domain but can be transferred to the client on request.

  • MM Web Design may retain technical access to the domain for management and support purposes.

3. WEBSITE DESIGN TERMS

3.1 Design Approval

Once the initial design is presented, the client must provide written or electronic approval. Any changes requested after approval may be treated as updates and billed separately.

3.2 Compatibility

Websites are designed to be compatible with the latest versions of major browsers and mobile devices. Compatibility with all browsers, devices, or outdated systems cannot be guaranteed.

3.3 Delivery Timeline

Estimated timelines are provided in good faith. Delays may occur due to:

  • Late client feedback or content delivery

  • Third-party dependencies

  • Technical or operational constraints

Such delays do not constitute a breach of contract.

3.4 Revisions

Clients are entitled to two (2) reasonable revision rounds during the design phase.
Further changes will be considered updates and charged accordingly.

3.5 Testing & Launch

We test websites before launch. Clients must review the website and report any issues within a reasonable time after delivery.

4. CONTENT RESPONSIBILITY

  • Clients are responsible for providing all text, images, logos, and materials.

  • Clients confirm they own or have legal rights to all supplied content.

  • MM Web Design is not liable for copyright, trademark, or legal violations caused by client-supplied content.

  • We may assist in sourcing royalty-free images where required.

5. MAINTENANCE, UPDATES & SECURITY

  • Ongoing maintenance and updates are not included unless specified in a maintenance agreement.

  • Reasonable security measures are implemented; however, absolute security cannot be guaranteed.

  • The client is responsible for website content security after launch unless maintenance services are active.

6. REFUND POLICY

  • Website design packages qualify for a 50% refund within 7 days of purchase only if work has not commenced.

  • No refunds are available once the design process has started.

  • Domain registrations and third-party services are strictly non-refundable.

7. HOSTING STORAGE LIMITS

  • Landing Page Package: 512MB

  • Business Website Package: 1GB

  • Custom Design Package: 5GB

Exceeding allocated storage may require an upgrade or additional fees.

8. OWNERSHIP & ACCESS

  • The website framework, structure, templates, and code remain the property of MM Web Design (Pty) Ltd.

  • The client is granted a license to use the website while services remain active.

  • Backend/admin access may be restricted to protect system integrity.

  • Ownership transfer must be agreed to in writing and may incur additional costs.

9. MONTHLY PAYMENTS & SUSPENSION

  • Monthly payments must be made on or before the due date.

  • If payment is not received, the website and related services may be suspended.

  • A R10 reactivation fee applies once payment is received.

  • Continued non-payment may result in permanent termination of services.

10. ACCEPTABLE USE POLICY (AUP)

Clients may not use any website, hosting, email, or domain services for unlawful, abusive, or harmful activities, including but not limited to:

  • Fraud, scams, phishing, or impersonation

  • Spam, bulk unsolicited emails, or email abuse

  • Malware, viruses, or malicious scripts

  • Hosting illegal, offensive, or prohibited content

  • Copyright infringement or intellectual property violations

  • Money laundering, identity theft, or deceptive practices

  • Activities that compromise server or network security

  • Any activity that violates South African or international law

MM Web Design does not actively monitor content but reserves the right to investigate reported or suspected abuse.

11. EMAIL USAGE POLICY

Email services may not be used for:

  • Spam or unsolicited bulk messaging

  • Phishing or deceptive communications

  • Distribution of malware or harmful links

  • Misrepresentation of identity or business affiliation

MM Web Design may immediately suspend or disable email accounts involved in abuse without prior notice.

12. SUSPENSION FOR ILLEGAL OR ABUSIVE USE

MM Web Design (Pty) Ltd reserves the right to immediately suspend or terminate services without notice if services are used for illegal, abusive, or suspicious activities, or if required by law enforcement or regulatory authorities.

Outstanding balances remain payable after suspension or termination.

13. LIMITATION OF LIABILITY & INDEMNITY

  • MM Web Design (Pty) Ltd is not liable for:

    • Loss of data, income, or business

    • Website downtime or hosting interruptions

    • Search engine rankings or performance

    • Third-party service failures

  • Clients use our services at their own risk.

  • The client agrees to indemnify and hold harmless MM Web Design (Pty) Ltd from any claims, damages, penalties, or legal actions arising from misuse of services.

14. PRIVACY POLICY

We collect and process personal information in accordance with applicable data protection laws.

Information Collected

  • Name, contact details, billing information

  • Website usage data (IP address, browser type)

Use of Information

  • Service delivery and billing

  • Communication and support

  • Service and website improvement

Data Sharing

Personal information is not sold and is only shared with third parties (e.g., domain registrars, payment processors) where required to provide services.

Data Retention

Data is retained only as long as legally or operationally required.

15. MODIFICATIONS

MM Web Design (Pty) Ltd reserves the right to modify these Terms and Conditions at any time. Updates will be published on our website.

16. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.
